What’s the role?
Reporting to the General Counsel and Company Secretary, you’ll join a high-performing legal and compliance team to provide support and advice to Plenti business units on legal and compliance issues with a particular focus on consumer credit and financial regulatory frameworks, privacy law, disputes (including EDR), and AML/CTF matters.
What will you be responsible for?
Legal and compliance advice: Working directly with the business to advise on a range of legal and compliance matters covering consumer credit and financial services law, consumer law, privacy law, and AML/CTF regulation.
Hands on engagement in key product initiatives and transactional work: You will be directly supporting the growth of a fast paced and leading fintech in advising the business on any legal considerations regarding new products, services and features.. You will play an integral role in providing project and product teams with advice and pragmatic solutions taking into account regulatory requirements. You will also play a key role in supporting our Treasury team in our securitisation program.
Corporate advisory and commercial matters: You will be a trusted resource for general commercial requests originating from the business which will include drafting and reviewing a wide array of commercial agreements, including non disclosure agreements, introducer agreements with loan referral partners, memorandums of understanding and commercial agreements with partners and service providers. You will also be required to review and draft and maintain loan contracts for consumer (regulated and unregulated) and commercial borrowers across the Group’s various funding sources.
Governance: Assisting the company secretary with preparation of board and committee papers and providing assistance in governance related matters concerning the Group.
Litigation, regulatory engagement and disputes: Provide assistance as required in relation to litigated matters, regulator inquiries and interactions and customer disputes.
Monitoring of legal & regulatory changes: You will be expected to stay abreast of upcoming regulatory reforms, and keep the Group aware of such matters, as well as preparing and implementing required changes in consultation with your Compliance colleagues to ensure compliance is achieved at all times.
What will make you successful in this role?
• Tertiary qualifications in law and admission to practice in NSW or another State or Territory
• Minimum 6 years’ PQE
• Fast learner with solid written communication and problem-solving skills
• An ability to work autonomously as well as engage with others in a team environment
• A capacity to work on multiple tasks simultaneously
• A commercial approach to problem solving with stakeholder management skills
• Demonstrated experience in banking and financial services law
• Thorough knowledge of the consumer credit regulatory framework
• Thorough knowledge of financial services legislation including the Corporations Act and AML/CTF Act and Rules.
• Experience with managed investment schemes
• Experience in advising on matters relating to the Australian Consumer Law.
